1. Acceptance of Terms
By installing, accessing, or using SocialStitch ("the App," "we," "our," or "us"), you ("User," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
These terms apply to all users of the App, including merchants who install the App from the Shopify App Store.
2. Description of Service
SocialStitch is a social media marketing application that provides:
- AI-powered product mockup generation using Google Gemini
- AI-assisted caption creation for social media posts
- Scheduling and publishing posts to Facebook Pages and Instagram Business accounts
- Integration with Shopify product catalogs
- Content management and calendar features
3. Account Requirements
To use SocialStitch, you must:
- Have an active Shopify store
- Install the App through the Shopify App Store
- Have a Facebook Page and/or Instagram Business account to connect (for posting features)
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have the authority to bind yourself or your business to these terms
4. User Responsibilities
You agree to:
- Provide accurate information when using the App
- Maintain the security of your connected accounts
- Comply with all applicable laws and regulations
- Comply with Facebook/Meta's Terms of Service and Community Standards
- Comply with Instagram's Terms of Use and Community Guidelines
- Comply with Shopify's Terms of Service
- Not use the App for any illegal or unauthorized purpose
- Not upload content that infringes on intellectual property rights
Content Responsibility: You are solely responsible for all content you create, upload, or publish through the App. This includes ensuring you have the rights to use any images and that your content complies with platform guidelines.
5. Subscription and Billing
SocialStitch offers various subscription plans through Shopify Billing:
- Billing is handled entirely through Shopify's billing system
- Subscription charges appear on your Shopify invoice
- You may cancel your subscription at any time through your Shopify admin
- Refunds are subject to Shopify's refund policies
- We reserve the right to modify pricing with 30 days notice
6. AI-Generated Content
Regarding AI features (mockup generation, caption suggestions):
- AI-generated content is provided "as-is" and may require review and editing
- You are responsible for reviewing all AI-generated content before publishing
- We do not guarantee the accuracy, appropriateness, or effectiveness of AI outputs
- You retain ownership of content you create using our AI tools
- We may use anonymized usage data to improve our AI features
7. Social Media Platform Integration
When connecting Facebook and Instagram accounts:
- You authorize us to post content on your behalf as directed by you
- You must maintain valid authorization with Meta platforms
- We are not responsible for changes to Meta's APIs or policies that affect functionality
- You can disconnect your accounts at any time through the App settings
- We do not guarantee uninterrupted access to posting features
8. Intellectual Property
Your Content: You retain all rights to content you upload or create. By using the App, you grant us a limited license to process, store, and display your content as necessary to provide our services.
Our Content: The App, including its design, features, and documentation, is owned by SocialStitch and protected by intellectual property laws. You may not copy, modify, or distribute our App or its components.
9. Prohibited Uses
You may not use the App to:
- Violate any laws or regulations
- Infringe on others' intellectual property rights
- Post spam, misleading content, or unauthorized advertising
- Harass, abuse, or harm others
- Distribute malware or engage in phishing
- Attempt to gain unauthorized access to our systems
- Interfere with the App's operation or other users' access
- Resell or redistribute the App's services without authorization
10. Service Availability
We strive to maintain reliable service but:
- We do not guarantee 100% uptime or availability
- We may perform maintenance that temporarily affects service
- Third-party services (Meta, Shopify, Google) may experience outages beyond our control
- We reserve the right to modify or discontinue features with reasonable notice
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALSTITCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Failed or delayed posts to social media
- Content removed by social media platforms
- Business interruption
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Accuracy or reliability of AI-generated content
- Uninterrupted or error-free operation
- Compatibility with all devices or platforms
13. Indemnification
You agree to indemnify and hold harmless SocialStitch and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Content you create or publish through the App
- Your violation of these Terms
- Your violation of any third-party rights
14. Termination
Either party may terminate this agreement:
- You: By uninstalling the App from your Shopify store at any time
- Us: By suspending or terminating your access for violation of these Terms
Upon termination, your right to use the App ceases immediately. We may delete your data in accordance with our Privacy Policy.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending notification through the App or email for material changes
Continued use of the App after changes constitutes acceptance of the new Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SocialStitch regarding your use of the App.
